A brief rumination of the Highly contentious Political Parties (Amendment) No. 2 Bill 2021.
In a condensed form, the Bill seeks to bring about the following:
- Introduction of corporate membership into the Political Parties Act
- Exemption of sections 14(4) and 14(5) from applying to the intended corporate members
- Provision of different membership categories in every Political Party’s constitution
- Provision of rules governing corporate membership within every Political Party’s constitution
Corporate Membership
- Definition
A political party a member of another political party
- Becoming a corporate member:
- In accordance with the constitution, rules and procedures of the political party intending to become a corporate member
- Through a resolution of the relevant party organs
- The party constitution to include rules governing corporate membership
Exemptions
Exemption of sub-sections 14(4) and 14(5) from applying to corporate members, Subsections 14(4) and 14(5) provide respectively:
- A person shall not be a member of more than one political party
- Any person, while being a member of another political party; form, join in the formation, join, advocate for the formation, or promote the ideologies of another Political party shall be deemed to have resigned from the previous Political party.
Different Membership Categories
The bill seeks to introduce different levels or categories of members in the PPs’ constitution e.g life members etc
Rules Governing Corporate Membership
The bill seeks to incorporate within the Political Parties’ constitutions rules to govern the intended corporate membership.
